Terms of Service

The Service is operated under the Promptgasm brand by DreamPrompting LLC, a limited liability company being registered in the Commonwealth of Pennsylvania, USA. In these Terms, “Promptgasm,” “we,” “us,” and “our” refer to DreamPrompting LLC.

These Terms apply whenever you access or use the Service. If you use the Service for an organization, you confirm that you have authority to accept these Terms for that organization. In that case, “you” includes the organization.

You must be at least 18 years old, or the age of majority where you live if it is higher, to create an account or use the Service. By using the Service, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

You may use the Service only where doing so is lawful. You are responsible for complying with the laws that apply to you and your use of the Service.

You may create an account using an email address and password or Google Sign-In. You must confirm your email address. A small starter credit is added after confirmation.

You must provide accurate account information, keep it current, protect your password and sign-in credentials, and prevent unauthorized access to your account. You are responsible for activity through your account unless applicable law provides otherwise.

You may not share, transfer, sell, or allow another person to misuse your account. Contact [email protected] promptly if you believe your account or credentials have been compromised.

Promptgasm is an AI studio where registered users can create images and short videos of fictional adults using text prompts and their own uploads. Features may include text-to-video, image-to-video, text-to-image, image editing, photoshoots from your own photo, duo scenes, and video restyling.

Prompts and uploads may be sent to third-party AI model and inference providers to produce results, including providers located outside your country. Our Privacy Policy provides more information about this processing.

AI generation may fail, be delayed, or produce results that do not match your expectations. We do not guarantee that the Service, any feature, or any particular model will always be available, uninterrupted, secure, or error-free. We may maintain, modify, restrict, suspend, or discontinue parts of the Service where reasonably necessary to operate, protect, or update it.

The Service uses credits. Credits are consumed for each generation according to the applicable tool and settings. The required number of credits is shown through the Service.

If a generation fails, the credits used for that generation are refunded to your account automatically.

Credits are a limited license to use the Service. They are not money, electronic money, stored value, or a deposit; they have no cash value and cannot be redeemed for cash. Credits do not expire while your account exists.

Credits may not be transferred between accounts or resold. If your account is deleted or terminated, any remaining credits can no longer be used and are not refundable except where applicable law requires otherwise.

Credits are sold in one-time prepaid packs priced in US dollars. Promptgasm does not offer subscriptions or automatic renewals.

Payments are handled by third-party payment processors. Your purchase may also be subject to the payment processor’s terms. You authorize the applicable processor to charge the payment method you select for the purchase shown at checkout.

You are responsible for reviewing the price and purchase details before completing payment.

Except where applicable law requires otherwise, all payments are final and non-refundable. This rule applies to unused credits and to results that you do not like, that do not meet your expectations, or that you decide not to use. Failed generations are handled through the automatic credit refund described above.

If you are a consumer in the European Union, European Economic Area, or United Kingdom, you keep all mandatory rights provided by applicable consumer law. Nothing in these Terms removes those rights.

Where the statutory right to cancel applies to digital content, that right ends once supply of the digital content begins with your express consent and acknowledgment that the cancellation right will be lost. Any other refund, remedy, or cancellation right required by applicable law remains available.

“Your Content” means the prompts, images, text, photographs, and other material you upload or submit, together with the results generated for you through the Service.

You keep the rights you already have in your uploads. You must have all rights, permissions, and consents needed to upload and process Your Content and to request the result you seek.

You authorize us and our service providers to host, transmit, process, reproduce, and display Your Content only as needed to provide, protect, moderate, and support the Service, enforce these Terms and the Content Policy, and comply with the law.

As between you and us, you have the right to use your generated results, subject to the Content Policy, these Terms, applicable law, and the rights of others. You are responsible for reviewing results and deciding whether your proposed use is lawful.

Your generated content remains private in your account library. You can download and delete creations from your library. Private status does not permit content that violates these Terms, the Content Policy, or the law.

You must follow the Promptgasm Content Policy. The Content Policy forms part of these Terms and provides more detail about permitted and prohibited uses.

Promptgasm is for creating fictional adults only. The following rules apply to every prompt, upload, generation, edit, and use of a result:

– Do not create, request, upload, possess, or use content involving minors, anyone who appears to be a minor, or anything suggesting minors.

– Do not use the identity, face, body, voice, likeness, or other personal characteristics of a real person without that person’s consent.

– Do not create non-consensual intimate imagery, impersonations, or deepfakes of real people.

– Upload images of yourself only, unless every other depicted person has consented and you have the rights needed to use the material.

– Do not create or upload violent, hateful, illegal, exploitative, abusive, or otherwise prohibited content.

– Do not infringe copyrights, privacy rights, publicity rights, or other rights belonging to another person.

– Do not attempt to bypass, disable, manipulate, or evade safety measures, moderation systems, or usage restrictions.

You are responsible for Your Content, your instructions to the Service, and how you use or distribute any result.

We use automated checks to screen prompts and uploads. A prohibited request may be refused before a result is created. Automated checks may not identify every violation and do not reduce your responsibility to follow these Terms and the Content Policy.

We may review reports, investigate suspected violations, refuse generations, restrict access, or remove content that violates these Terms, the Content Policy, or the law.

You may report prohibited content, abuse, or a suspected copyright violation to [email protected]. Include enough information for us to identify and review the matter.

Content involving minors will be reported to the appropriate authorities. We may also preserve or disclose information when required by law or a valid legal request.

We may suspend, restrict, or terminate your account or access to the Service if you violate these Terms or the Content Policy, use the Service unlawfully, create a risk of harm, attempt to evade our safeguards, or interfere with the operation or security of the Service.

Serious or repeated violations may result in content removal and account termination. We may take immediate action where reasonably necessary to protect users, other people, the Service, or the public, or to comply with the law.

Termination does not affect provisions that by their nature should continue to apply, including provisions concerning payment obligations, intellectual property, disclaimers, liability, indemnity, governing law, and disputes.

You may delete individual creations from your library or delete your account through the available account controls.

Deleting your account deletes the creations stored in your account and ends your ability to use any remaining credits. Payments and unused credits are not refundable because of account deletion, except where applicable law requires otherwise.

The Service, including its software, interface, design, text, graphics, and other materials provided by us, is protected by intellectual property laws and belongs to us or the applicable rights holders.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Service for its intended purpose. This right does not transfer ownership of the Service or its underlying technology to you.

You may not copy, sell, sublicense, distribute, reverse engineer, interfere with, or create unauthorized derivative works from the Service except where applicable law expressly permits that activity and does not allow it to be restricted by contract.

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be disclaimed.

AI-generated results may contain errors, defects, or unwanted material and may not satisfy your intended purpose. You must review each result before relying on, publishing, distributing, or otherwise using it. We do not provide legal clearance of your uploads, prompts, results, or proposed uses.

We do not guarantee continuous availability, successful generation, any specific result, or compatibility with every device or system.

Nothing in these Terms excludes any warranty, guarantee, remedy, or other right that cannot legally be excluded, including mandatory rights held by consumers.

To the fullest extent permitted by law, DreamPrompting LLC will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings, arising from or related to the Service or these Terms.

These limitations apply regardless of the legal theory asserted and even if we were advised that the loss was possible. They do not apply to liability that cannot lawfully be excluded or limited.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be limited, or any other matter for which applicable law prohibits a limitation. Your mandatory consumer rights remain unaffected.

To the extent permitted by applicable law, you will indemnify and hold DreamPrompting LLC harmless from third-party claims, losses, liabilities, damages, judgments, and reasonable legal costs arising from Your Content, your unlawful use of the Service or results, your infringement of another person’s rights, or your material breach of these Terms or the Content Policy.

This indemnity does not apply to the extent a claim results from our own unlawful conduct or where applicable consumer law does not permit the obligation.

These Terms are governed by the laws of the Commonwealth of Pennsylvania and applicable United States federal law.

Any dispute relating to these Terms or the Service may be brought in the courts located in Pennsylvania, unless the mandatory law of your country gives you, as a consumer, the right to rely on other law or bring proceedings in the courts where you live. Nothing in these Terms deprives a consumer of mandatory protections provided by the law of the consumer’s country.

These Terms do not require arbitration and do not include a waiver of the right to participate in a class or collective proceeding where such a proceeding is available under applicable law.

We may update these Terms to reflect changes to the Service, our practices, or applicable law. We will post the revised Terms and update the date shown at the top.

Changes will apply from their stated effective date. By continuing to use the Service after revised Terms take effect, you agree to the revised Terms. If you do not agree to a change, you must stop using the Service and may delete your account. Mandatory consumer rights remain unaffected.
